Decision-making capacity refers to a person’s capacity to act consciously in a specific situation. The person must be able to understand the meaning and consequences of their actions in the given context.
If the decision-making capacity is impaired it is advisable to prepare a power of attorney.
The power of attorney must be established in person and in writing in the presence of an attorney, a notary, or – in simpler legal cases – an adult protection association (formerly a guardianship association). It must then be entered in the Austrian Central Register of Representatives (Österreichisches Zentrales Vertretungsverzeichnis – ÖZVV).
